If you are selling:

  • Taking your initial instructions and giving initial advice in respect of the transaction
  • Reviewing title documentation and preparing contract documents
  • Obtaining information from you and responding to any enquiries received from the buyer's solicitor
  • Obtaining a redemption figure from your lender (if any)
  • Sending the final contract and transfer to you for signature together with a completion statement
  • Agreeing a completion date
  • Exchanging contracts and completing the sale
  • Repaying your existing mortgage (if any)
  • Paying the estate agents (if any)
  • Sending the net sale proceeds to you

  • Advice on tax implications
  • Dealing with any agricultural issues
  • Negotiating with any third party, including lenders, on your behalf
  • Advice on planning matters, valuation or financial matters

  • Receiving and advising you on contract and title documents
  • Carrying out all necessary searches and advising you on the results
  • Making any necessary enquiries of seller's solicitor and reporting to you on the replies
  • Reporting on all relevant documents and information received
  • Reporting on the conditions of your mortgage offer
  • Sending the final contract, transfer and other documents to you for signature with a draft completion statement
  • Agreeing a completion date
  • Exchanging contracts and notifying you that this has happened
  • Arranging for all monies needed to be received from your lender and you

  • Dealing with the payment of Stamp Duty Land Tax
  • Dealing with the application for registration at the Land Registry
  • Serving notice in accordance with the lease (if any)

  • Our purchase quote does not include:

  • Advice on tax implications (other than Stamp Duty Land Tax unless the transaction is not standard or there are complications which require a Stamp Duty Land Tax expert to advise and if this is the case you will be notified of this)
  • Advice on or preparation of Tenancy Agreements
  • Dealing with or advising on any agricultural issues
  • Negotiating with any third party, including lenders, on your behalf
  • Advice on planning matters, valuations or financial matters
  • If a Declaration of Trust is required a separate quote will be provided once we know what we are required to draft.

  • TimeScale

    How long the transaction will take, from the offer being accepted until completion takes place, will depend on a number of factors such as the length of the chain, any mortgage arrangements, time taken to obtain information from third parties such as Landlords and Management Companies and whether there is a sale under a grant of probate. The average process takes between 8 to 12 weeks from contract papers being issued or received.

    Lasting Powers of Attorney Fees

    The fees for Lasting Powers of Attorney are £250 plus VAT (currently 20%) per LPA form with an additional £82 Court fee for the registration of each LPA.


    Commercial Property Fees

    Commercial Property transactions are charged on an hourly basis of £275 plus VAT (currently 20%) per hour. Please contact us to discuss your needs and so that we can provide an estimate.


    Probate Fees Services and Timescales

    We charge probate work on an hourly basis at £275 plus VAT (currently 20%) per hour and our overall fees depend on the nature complexity and extent of the work undertaken on your behalf. Our fees are based on the time involved in dealing with the matter which will be influenced by the size and complexity of the estate and the type of assets involved and whether any inheritance tax is payable and whether you carry out any work yourself as considerable savings can be made if you do.


    Costs for a simple probate application where no inheritance tax is payable are likely to range from £750 plus VAT to £2,500 plus VAT (currently 20%).


    There will also be chargeable disbursements, such as Court Fees, (currently in the region of £150-170 and these are not subject to VAT). Probate Court fees and the costs of selling property are payable in addition to our fees.


    Costs for a full estate administration service will range from £2,500 plus VAT - £5,000 plus VAT (currently 20%) for a straightforward estate to in excess of £15,000 plus VAT (currently 20%) for a complex estate.


    Our full estate administration service will usually include:


  • Taking instructions and giving initial advice
  • Identify the type of probate application that you will require
  • Collating the information required for the Probate application
  • Preparing draft estate accounts and HMRC forms
  • Preparing Probate Application forms and applying for the Grant of Probate
  • Collecting in the assets of the Estate
  • Paying tax, liabilities and any legacies on behalf of the Estate
  • Dealing with HMRC
  • Preparation of Estate accounts and IHT tax returns
  • Calling in and distributing the residue of the estate

  • Our probate quote does not include:


  • The preparation or review of a Deed of Variation (which must be completed within two years of the date of death) - a separate estimate would be provided once we know what is required
  • Any other tax advice or returns other then those in respect of obtaining the Grant of Probate
  • The preparation of detailed estate accounts in a specific format
  • Any other tax implications
  • Tracing missing beneficiaries
  • Any fees incurred in respect of calling in overseas assets
  • Trust Advice

  • Timescales obviously depend upon the individual Estate, but in our experience and based on current estimated timescales from both HMRC and the Probate Court most estates are dealt with within 6-18 months.

    Debra Cooper - Solicitor

    Debra is the sole director of Chiltern Legal limited and she is a solicitor with 25 years' experience practising in all of the above areas. She works with Debbie Jones and Christina Morgan.     Debbie Jones is a Paralegal. She is a member of the Residential Property and Conveyancing team and her main focus is on Residential Property Purchases. She has over 30 years' experience in residential conveyancing matters and has been with Chiltern Legal Limited since October 2013.

    Christina Morgan

    Chritina Morgan is a Legal Assistant who assists Debra on all areas of the practice including conveyancing sale transactions, commercial property transactions and probate work. She has been with Chiltern Legal Limited since April 2006.
